Right of Refusal

We reserve the right to refuse service or products to any person or organization.

Accepting Policies and Conditions

When you hire ZuWerks, Inc. for Products or Services you accept the following Policies and Conditions

Payments

Payment Terms are NET 15: payment is due within 15 days of product delivery or service.  Forms of payment that are accepted are; cash, check, credit card, PayPal, and Google Wallet.  If payment is not received within 15 days there will be a 1.5% late fee per month.

Photography

RESCHEDULING, DELAYS AND CANCELLATIONS

Cancellations/Rescheduling require a 24-hour advance notice in order to avoid the Cancellation Fee of $65. Cancellations made less than 24 hours’ notice will be charged the full amount of your session. 

No-shows will be charged the full amount. If Listing is not ready when the photographer arrives there will be a fee of $45 per hour.

If conditions warrant rescheduling, we leave it up to your discretion to reschedule. We ask that if you would like to do this, that you do it with as much notice as possible. We assume we are still shooting the property (interiors) unless you call/ email us to reschedule.

REAL ESTATE PROPERTY APPEARANCE & PREPARATION

It is the responsibility of either the Property owner, Management company and/or Real Estate agent to prepare the property for the photo shoot before the date scheduled for the photo shoot. If the property is not ready on the scheduled date and time, extra fees will apply. ZuWerks is not responsible for staging, moving objects and/or cleaning the property. ZuWerks will provide tips and suggestions for making the property look its best. ZuWerks does not shoot garages, and closets unless requested.

SERVICE AREA & TRAVEL FEE

Our standard service area is a 20 mile radius from Glendale after which we charge a Travel Fee. We travel all over Southern California and is determined by mileage. Please contact us for a quote.   

DELIVERY OF PHOTOGRAPHS

ZuWerks creates these bright and crisp images using a process called HDR, therefore some processing time is needed to edit the images and deliver the results you have been expecting.

Images are delivered within 48 business hours via email with links to both hi-resolution images, for your marketing materials, and low-resolution images, sized for the web and the MLS.

We will provide you with a minimum of 7-10 photos but the total amount depends on the size of the home.

LICENSING COPYRIGHTS AND PHOTO USAGE

ZuWerks  grants non-exclusive rights of all images produced for agent and its broker for use by said agent and/or broker for any and all marketing materials and campaigns associated with the property and for the agent’s self-promotion. The photos may also be used by the agent’s parent company for the sole purpose of marketing the specific property photographed. 
Please note however, that all the images are owned and copyrighted by the ZuWerks, and licensed granted only to the agent and the agent’s parent company and not to any third parties. These images are not transferable or sellable. Any usage of the images by a third party, including but not limited to other agents, brokers, architects, builders, stagers, designers, sellers, or buyers, is strictly prohibited unless additional licenses are acquired from ZuWerks, Inc..

Graphics and Print

COLOR PROOF ACCURACY

Please note that although color proofs supplied to the customer are highly calibrated and very accurate, they cannot match the final printed product 100%. This is due to the fact that proofs are created in a different way than the printed piece (ink, paper stock, registration, line screens, etc.) Also note that the customer proof may not closely match our proofs or the printed piece either for the same reasons, and because the customer supplied proofs are not calibrated to our presses.

TURNAROUND TIME

Although we make every possible effort to turn jobs around in the estimated times offered, your job may require more time due to unforeseeable or uncontrollable circumstances or finishing services added onto the job. We will not credit customers if a job runs past the estimated turnaround time. TURNAROUND TIMES ARE AN ESTIMATE, NOT A GUARANTEE!

DUE DATES DURING HOLIDAY CLOSURES…

Turn Times and Due Dates will be increased during any Holiday Closure we have. Please understand that any order in production during a holiday or placed on the holiday will be pushed by 1 day minimum. The due date will not read properly so please make note of any holidays and turn times.

LOCAL DELIVERY

Local Delivery is a courtesy service available to customers within predetermined geographical regions of our production facilities. If no one is available to receive deliveries, packages will be left without requiring a signature, at which point we are released from liability. We will not make multiple delivery attempts

CUSTOMER PROVIDED CONTENT

For certain product and service offerings you may elect to electronically upload or otherwise submit data, text, photographs, graphics, messages or other materials (collectively, “Customer Content”) to ZuWerks, Inc. for inclusion in print products. You understand and agree that you (and any other person from whom it may have originated) are solely responsible for all Customer Content. When you upload, or otherwise provide Customer Content to ZuWerks, Inc. you warrant and confirm that you either own the copyright to or have permission to copy any documents, text, graphics, photographs, etc., that you submit for inclusion in the print process, and you agree to defend, indemnify and hold ZuWerks, Inc. and its officers, directors, employees, shareholders agent and affiliates, harmless from any suit, demand, or claim arising out of any breach of this warranty and agree to pay any judgment or reasonable settlement offer resulting from any such suit, demand or claim, and to pay any attorney’s fees incurred by ZuWerks, Inc. in defending against such suit, demand or claim.

COLOR QUALITY

ZuWerks, Inc. guarantees that its prints will meet CMYK industry standards. We cannot guarantee “match-print” color fidelity and cannot prevent slight color shift throughout an order. Because we cannot control the color reproduction of a customer’s computer monitor, we cannot guarantee that the actual print color will precisely match any preview as it appears your monitor. ZuWerks, Inc. is not responsible for any color shift in converted photographs (RGB images) with black, near black, or gray tones. Color shifts from a perceived black or gray must be addressed prior to file submission. Proofs do not guarantee black, near black or gray final output. Please note that the application of UV coating may have an effect upon or change the appearance of printed colors. ZuWerks, Inc. is not liable for the final color appearance of a UV coated product.

OVER/UNDER RUNS

Although we endeavor to provide the quantity ordered, ZuWerks, Inc. reserves the right to ship within 5% over or under the requested quantity. If a minimum quantity is a necessity we recommend that you adjust the total quantity ordered to account for the possibility of an under run.

ORDER APPROVAL/ PROOFING

ZuWerks, Inc. has and assumes no obligation to proof or otherwise review the content or layout of your order. Even if a ZuWerks, Inc. customer service representative has inquired as to the attributes of one of your prior orders, you are not entitled nor should you assume that ZuWerks, Inc. will review any other order you place. Orders are printed in their “as submitted” form and the customer is fully responsible for final proof and layout verification and approval prior to submission to the print process. ZuWerks, Inc. DOES NOT make any changes on customer files. Once you submit an order to the print process you are agreeing that you are fully satisfied with the document layout and content and you accept responsibility for any errors therein. ZuWerks, Inc. will assume that you have verified the spelling, grammar, content and layout, etc. are all correct and it will not accept any liability for errors such as misspelling, graphics, grammar, damaged fonts, punctuation, transparency, overprint, improper layout, bleeding, erroneous cut or fold lines, die lines or crop marks, sizing, etc.

ZuWerks, Inc. does not provide proofs of any order unless the customer requests it as part of the order process and it is an option available for the product. If you request a proof then it is your responsibility to verify the proof against the original (and to correct any spelling or grammatical errors, etc).

If a proof is requested, then your job will not be processed or deemed production ready until you have approved the proof in writing. Please be aware that this may impact the job turnaround time.

MAILING SERVICES

We are responsible for collecting postage from you, scheduling your job to mail and passing your mailing payment to U.S. Postal Service (USPS). Our responsibilities end when USPS accepts your mailing from us. We provide upon request a proof of mailing statement (3600 for first class mail, 3602-R for standard class and 3602-NP for the Non-Profit mail) as USPS makes each available to us (typically within 24 – 48 hours of the order’s drop date). Lost mail, non-delivered mail and mail-transit time are the responsibilities of the USPS and we cannot be held liable for any of these issues. USPS will not give a refund on postage for non-delivered mail.

First Class Mail reaches its destination in 1-5 days (average); Standard Class and Non-Profit mail reach destinations in 7-10 days (average, though many mailings reach destinations much faster).

Mailing lists are kept confidential. They will not be sold or used for any purpose other than your mailing and will then be deleted.

We are not responsible for nor do we guarantee delivery or a response to your mailing.

If there is an issue with your order and we are found to be at fault,we will only accept liability up to the cost of goods and services provided. This does not include any postage cost. By using our services, you release us from liability for any loss of revenue, business or implied damages.
